Workers' Compensation Insurance

The definition: a form of insurance providing wage replacement and medical benefits to
employees injured in the course of employment in exchange for mandatory relinquishment
of the employee's right to sue their employer for the tort of negligence. Very complicated.
South Dakota - All employers must carry insurance, regardless of the number of employees. Sole proprietors and partners are excluded, but may choose to be included. Purchased from a commercial carrier. Approved businesses may self-insure - see South Dakota Department of Labor and Regulation
Tennessee - Every employer with five or more employees must carry coverage.
Sole proprietors, LLC members, and partners are excluded but may choose to be included. Purchased from a commercial carrier. Approved businesses may self-insure - see Tennessee Department of Labor and Workforce Development
Texas - Workers’ compensation insurance is optional for employers in Texas.
Sole proprietors, partners, corporate officers, and LLC members in are included under state coverage, but can choose to opt out. Purchased from a commercial provider or Texas’ state-administered fund. Approved businesses may self-insure - see Texas Department of Insurance
Utah - All employers are required to carry coverage for employees. Sole proprietors, partners and LLCs are not required to have coverage but may choose to be covered.
